Terms of Use

Acceptance of terms

These Terms of Use govern access to and use of BinaryBias, including the website, application, paid subscription features, model outputs, archives, data displays, documentation, and related support channels. By creating an account, starting a subscription, accessing the service, or using any content made available through BinaryBias, you agree to these terms.

If you access BinaryBias for a company or other organisation, you represent that you are authorised to bind that organisation. In that case, "you" and "your" include that organisation. If you do not agree to these terms, you must not use the service.

Service scope

BinaryBias provides paid, non-personalised foreign exchange probability analytics, model observations, market-data-derived displays, and archives for informational and research purposes only. The service is designed to show general model output about selected FX pairs and timeframes. It is not designed for any user's financial situation, objectives, risk tolerance, account balance, portfolio, tax position, or trading restrictions.

BinaryBias is not a broker, dealer, investment adviser, portfolio manager, asset manager, execution venue, signal seller, introducing broker, copy-trading provider, binary-options provider, or account management service. The service does not open, close, route, transmit, arrange, or execute orders.

Eligibility and account responsibility

You may use BinaryBias only if you can lawfully enter into these terms and lawfully access the service in your jurisdiction. You must provide accurate account, billing, and contact information and keep it current. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

You must promptly notify BinaryBias through the available support or account contact channels if you believe your account has been compromised or used without permission. BinaryBias may require identity, account, or billing verification before providing support, changing account access, or restoring service.

No advice, broker, or execution service

BinaryBias content is non-personalised information. It is not investment, financial, legal, tax, accounting, trading, suitability, or other professional advice. No output is a recommendation to buy, sell, hold, enter, exit, hedge, size, roll, or otherwise transact in any currency pair, derivative, binary option, contract for difference, or other financial product.

BinaryBias does not assess suitability or appropriateness, does not monitor your account, does not manage a portfolio, does not provide account-specific position sizing, and does not accept instructions to trade. You remain responsible for obtaining independent advice from appropriately qualified professionals before making financial, tax, legal, or investment decisions.

Prohibited uses

You must not use, market, connect, or repackage BinaryBias to:

  • operate or support a binary-options signal service, transaction instruction service, copy-trading service, mirror-trading service, managed account service, or auto-trading system;
  • trigger, route, transmit, pre-fill, automate, or recommend orders through APIs, webhooks, browser automation, broker integrations, or other execution workflows;
  • present BinaryBias content as personalised advice, regulated investment research, an investment recommendation, or a guaranteed or expected outcome;
  • scrape, crawl, bulk download, resell, syndicate, redistribute, or create a competing dataset or service from BinaryBias content except as expressly permitted in writing;
  • circumvent access controls, share paid seats outside the licensed account, interfere with service operation, or test the service for security vulnerabilities without written authorisation; or
  • use the service in violation of law, sanctions, exchange rules, market-abuse rules, consumer-protection rules, advertising rules, financial-services rules, or third-party rights.

Subscriptions, billing, and refunds

Paid plans provide access to the coverage, features, pairs, timeframes, archives, and usage limits described at checkout or in the applicable order page. Subscription fees, billing cycles, taxes, payment methods, trial terms, renewal dates, cancellation flows, and refund rights are subject to the checkout terms and the rules of the payment provider used for the transaction.

Unless the checkout terms say otherwise, subscriptions renew automatically until cancelled. Cancelling a subscription stops future renewals but does not necessarily provide a refund for the current billing period. BinaryBias may change plan features or fees on notice where required by law or contract. If you do not accept a material change, your remedy is to cancel before the change takes effect, except where applicable law provides another remedy.

User responsibilities and restrictions

You are solely responsible for deciding whether you may access BinaryBias and whether any financial product, market, or trading activity is lawful and appropriate for you. Availability of the service in a jurisdiction does not mean BinaryBias is approved for use there or that any related product may be lawfully traded there.

You must comply with all laws, rules, and restrictions that apply to you, including restrictions based on residence, citizenship, employer, regulatory status, professional classification, sanctions status, product eligibility, and platform or broker terms. You must not use BinaryBias where doing so would require BinaryBias to obtain a licence, registration, approval, or authorisation that it does not hold.

Intellectual property and content licence

BinaryBias and its licensors own the service, software, interfaces, model outputs, design, documentation, databases, compilations, trademarks, and other content, except for content you provide or rights expressly owned by third parties. No rights are transferred except as expressly stated in these terms.

Subject to these terms and your paid plan, BinaryBias grants you a limited, revocable, non-exclusive, non-transferable licence to access and use the service for your own internal informational and research purposes. You may not copy, modify, publish, sell, lease, sublicense, reverse engineer, or create derivative services from BinaryBias except as permitted by law or by written agreement.

Market and model data limitations

Market data, price histories, derived indicators, probabilities, statistics, timestamps, and model outputs may be delayed, incomplete, inaccurate, unavailable, restated, or affected by feed errors, calculation errors, software defects, liquidity conditions, market disruptions, holidays, outages, and changes in methodology. Past observations, backtests, confidence measures, directional accuracy figures, or historical performance do not predict future results.

BinaryBias may correct, remove, restate, or stop publishing any data or model output at any time. BinaryBias is not the only source to use for market data, valuation, risk management, or compliance information.

Availability and changes

BinaryBias may modify, suspend, limit, replace, or discontinue any part of the service, including datasets, pairs, timeframes, models, pricing, access methods, and user-interface features. BinaryBias does not guarantee uninterrupted access, realtime delivery, error-free operation, permanent archives, or compatibility with any device, browser, broker, data vendor, or third-party platform.

Maintenance, security work, infrastructure changes, vendor outages, legal requirements, abuse prevention, and market-data restrictions may affect availability. Any service-level commitments, if offered, must be stated in a separate written agreement or plan-specific terms.

Suspension and termination

BinaryBias may suspend or terminate access if you breach these terms, fail to pay fees, create legal or operational risk, misuse the service, violate applicable restrictions, or if continued access would be unlawful or commercially impractical. BinaryBias may also suspend access to protect the service, users, data providers, payment systems, or third-party platforms.

You may stop using the service at any time and may cancel your subscription through the available account or billing flow. Terms that by their nature survive termination include ownership, restrictions, disclaimers, liability limits, indemnity, payment obligations, and dispute provisions.

Third-party services

BinaryBias may rely on third-party providers for hosting, authentication, payments, analytics, market data, databases, realtime messaging, email, security, and support. Third-party services may be subject to their own terms, privacy notices, availability limits, and fees. BinaryBias is not responsible for third-party products or services that it does not control.

Privacy and cookies

BinaryBias processes personal data as described in the Privacy Notice and uses cookies or similar storage as described in the Cookie and Storage Notice.

Disclaimers

To the maximum extent permitted by applicable law, BinaryBias is provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise. BinaryBias disclaims warranties of accuracy, completeness, merchantability, fitness for a particular purpose, title, non-infringement, availability, security, realtime delivery, and error-free operation.

BinaryBias does not warrant that any model output, probability, statistic, alert, archive, or display will be correct, current, complete, profitable, suitable, compliant, or available when needed. You assume all risk arising from your interpretation or use of the service.

Limitation of liability

To the maximum extent permitted by applicable law, BinaryBias and its owners, directors, employees, contractors, affiliates, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or lost-profit damages; trading losses; investment losses; business interruption; data loss; loss of goodwill; or losses arising from market movement, model output, service unavailability, unauthorised access, or third-party services.

To the maximum extent permitted by applicable law, BinaryBias's total liability for all claims relating to the service will not exceed the amount you paid to BinaryBias for the service during the 12 months before the event giving rise to the claim, or EUR 100, whichever is greater. Some jurisdictions do not allow certain limits, so some limits may not apply to you.

Indemnity

To the extent permitted by applicable law, you will indemnify and hold BinaryBias and its owners, directors, employees, contractors, affiliates, licensors, and service providers harmless from claims, losses, liabilities, damages, costs, and expenses, including reasonable legal fees, arising from your misuse of the service, breach of these terms, violation of law, infringement of third-party rights, or use of BinaryBias in connection with trading, order routing, copy trading, binary options, resale, redistribution, or regulated activity.

Governing law and venue

These terms are governed by the laws of Denmark, except where mandatory consumer-protection or conflict-of-law rules require otherwise. Disputes must be brought before the competent Danish courts, except where mandatory law gives a user the right to bring a claim in another forum.

Changes to these terms

BinaryBias may update these terms to reflect legal, regulatory, technical, product, vendor, pricing, or risk changes. The updated date above identifies the latest version. Continued use after an update means you accept the updated terms, except where applicable law requires additional notice or consent.
